Beta Terms and Conditions
BETA§ 1 Scope and Beta Status
These Beta Terms and Conditions (hereinafter "Beta Terms") govern the use of the SEOFuxx platform (hereinafter "Service") at www.seofuxx.com during the active beta phase. The provider is SEOFUXX, Europaplatz 2, 10557 Berlin, Germany (hereinafter "Provider").
The Service is under active development. By using the Service, you expressly accept these Beta Terms. They apply in addition to the general Terms of Use; in case of conflict, the Beta Terms take precedence.
These Beta Terms remain in effect until the Provider announces the official production launch and regular Terms and Conditions come into force.
§ 2 Access and Registration during the Beta Phase
Access to the beta version may be open, restricted, or by invitation. The Provider reserves the right to restrict, suspend, or permanently revoke access at any time and without giving reasons – including without prior notice.
By registering, you acknowledge that:
- the Service is unfinished software that may contain bugs, outages, and data loss;
- features, limits, and functionality may be changed, restricted, or removed at any time;
- there is no entitlement to continued access or the retention of any specific features;
- stored data may be reset or deleted (e.g. during database migrations).
§ 3 Scope of Services and Availability
The Provider makes the Service available during the beta phase without any guarantee of specific availability or stability. There are no obligations regarding Service Level Agreements (SLA), response times, or uptime guarantees.
The Provider is entitled to shut down, interrupt, or fundamentally change the Service at any time – even without prior notice – in particular for:
- maintenance and updates;
- database migrations or infrastructure changes;
- security or stability measures;
- fundamental changes to the product.
§ 4 Quotas, Crawls, and Usage Limits
During the beta phase, the following usage limits and quotas may apply, all of which may change at any time without prior notice:
- Crawler quota: The number of available website crawls per period (day, week, month) may be adjusted by the Provider at any time – up or down;
- Analysis limits: Maximum page count per crawl, analysis depth, and data retention may change;
- API quotas: Access limits to external data sources (e.g. SERP data, keyword data) may vary;
- User accounts: The number of manageable projects, domains, and stored analyses may be restricted or expanded;
- Data retention: Storage periods for analysis results may be changed without notice.
The Provider will endeavour to announce significant changes to quotas via email or in-app notification in a timely manner, but assumes no obligation to do so.
§ 5 Free Use and Future Pricing
Use of the Service during the beta phase is generally free of charge, unless expressly communicated otherwise. Costs arise exclusively for optional premium features that are labelled as paid.
Upon the end of the beta phase, the Provider reserves the right to introduce a paid model. Existing beta users will be informed at least 30 days before the transition and may receive special conditions.
§ 6 Feedback and Participation
Beta users are expressly invited to report bugs, submit suggestions for improvement, and actively participate in the development process. Feedback can be submitted via the provided channels (contact form, email, forum).
By submitting feedback, ideas, or suggestions, you grant the Provider a royalty-free, worldwide, transferable, and unlimited right to use these for the further development of the Service. There is no right to compensation or attribution.
§ 7 Limitation of Liability during the Beta Phase
The Service is provided during the beta phase "as-is". The Provider assumes no liability for:
- data loss caused by bugs, crashes, or migrations;
- outages, interruptions, or malfunctions of the Service;
- incorrect or incomplete analysis results;
- lost profits or other indirect damages resulting from use of the beta service;
- changes or removal of features.
Liability for damages arising from injury to life, body, or health, as well as for intent and gross negligence, remains unaffected.
§ 8 Privacy
The collection and processing of personal data is governed by the Provider's Privacy Policy, available at /datenschutz. During the beta phase, extended usage data (e.g. click paths, error logs) may be collected for analysis and improvement purposes. This is disclosed transparently in the Privacy Policy.
§ 9 Termination and End of the Beta Phase
You may terminate your use of the Service at any time by deleting your account or informally notifying the Provider.
The Provider is entitled to end the beta phase at any time and:
- permanently discontinue the Service;
- transition the Service to regular operation (in which case the regular Terms and Conditions apply);
- deactivate individual user accounts if they violate these Beta Terms.
In the event the Service is discontinued, beta users will be informed at least 14 days in advance, where circumstances permit.
§ 10 Changes to the Beta Terms
The Provider reserves the right to amend these Beta Terms at any time with effect for the future. Changes will be announced by email or through a notice within the Service. If you continue to use the Service after such a change, this constitutes your acceptance of the revised version.
§ 11 Severability
Should any provision of these Beta Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by an effective provision that comes closest to the economic purpose.
§ 12 Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction for all disputes arising from this contract is Berlin, Germany, provided the customer is a merchant, legal entity under public law, or has no general place of jurisdiction in Germany. For consumers, the statutory place of jurisdiction applies.
